How to get divorced

If  your marriage has broken down and you do decide that divorce is the right step for you, you will firstly need to understand the legal requirements to be able to get divorced.

You will need to be able to prove one of five grounds:

  1. Adultery by your spouse
  2. Unreasonable behaviour by your spouse
  3. Desertion – where your spouse has left you for a period of two years
  4. Two years separation from your spouse and they consent to a divorce
  5. Five years separation from your spouse in which case their consent is not necessary

To start WITH you must fill in a Divorce Petition Form with some basic details about you and your spouse, about your children and childcare arrangements. and enclose your marriage certificate.

Once your documents have been submitted to the court along with your fee, your spouse must respond. After this the judge will decide whether to grant a Decree Nisi.

Decree Nisi
You can obtain a Decree Nisi if your spouse does not contest the divorce petition.

Decree Absolute

A decree absolute is the legal document which ends your marriage.  6 weeks after obtaining your Decree Nisi you can apply for a Decree Absolute. This six week delay is an ideal time for you to finalise all the other parts of the settlement prior to the legal termination of your marriage. It is worth noting that during this period it is not too late should you wish to change your mind about being divorced.

A Legal Costs Allowance from the other party

If you substantially depend on the other party for financial support, we may be able to secure an order that results in them paying for your ongoing legal fees. This is classed as part of your regular maintenance payments. Again, there are some fairly stringent criteria, so talk to us about the process involved.

A ‘Sears Tooth’ Agreement

A Sears Tooth Agreement is an agreement between solicitor and client that ensures the solicitor is paid for their guidance and actions throughout the divorce without causing financial fears for the client. The solicitor and their client agree that an appropriate amount of the client’s final divorce settlement is provided to the solicitor to meet the fees.
